Why can't the Board waive my late fees?


This is a question we get asked quite often, especially when a homeowner has never been late before. The fact is the association incurs expenses whenever dues are not paid on time.


The Management Company charges fees to print and send Late Letters. If payment is not received by 10 days after due date, a 'Notice of Late Assessment' (NOLA) letter is sent and once the NOLA expires an 'Intent to Lien Notice' is sent, which expires after 45 days. If the outstanding balance is still not paid then Attorney's get involved to record a lien on the property. All these activities generate additional fees which are passed through to the homeowner.
